Supreme Court allows Texas to arrest and detain immigrants under new immigration law

The U.S. Supreme Court allowed Texas to enact tough immigration law SB4, giving local and state authorities the power to arrest and prosecute such immigrants who cross the Mexican border into the United States.

The court’s decision marks a huge victory for Texas officials despite President Joe Biden calling the rule unconstitutional.

In addition to changing federal oversight of immigration enforcement, which traditionally involves federal officials throughout the process, SB4 also gives Texas authorities the authority to conduct similar activities against immigrants.

Enactment faced legal hurdles in the Legislature, with Justice Samuel Alito blocking the policy three previous times.

However, the Supreme Court’s ruling in favor of SB4, which began operating at the same time as the lower federal courts, also took effect.

Texas Attorney General Ken Paxton hailed the verdict as a breakthrough against federal overreach and his condemnation of violations of states’ rights.

Conversely, the American Civil Liberties Union, which had previously attacked the legislation in court, is now determined to continue fighting it until it is declared unconstitutional.

Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson wrote dissent, criticizing the law for undermining federal-state relations and significantly weakening protections for immigrants.

Under SB4, PE can stop and question individuals suspected of crossing the border, resulting in misdemeanor convictions, jail time, and hefty fines. Hot-button provisions of the law have raised concerns about shared jurisdiction and strained relations with Mexico.
